Terms of Service
Last Updated: October 21, 2026
Welcome to TruckAround. These Terms of Service (“Terms”) are an agreement between you and Pop-Up Galaxy, Inc., doing business as TruckAround (“TruckAround,” “Company,” “we,” “us,” or “our”). They govern your access to and use of the TruckAround app for iOS, Android and the web (the “App”), our public web pages about food trucks, our backend Application Programming Interfaces (“APIs”), QR codes, and related services (collectively, the “Services”).
By downloading, accessing, or using the App, APIs, or QR code(s) you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App or APIs.
1. Eligibility & US Service Restriction
- Age Requirement: You must be at least 13 years old to use the Services, and at least 18 to register as a Vendor. If you are under 18, you may use the Services only with the permission of a parent or legal guardian who agrees to these Terms. By using the Services, you represent and warrant that you meet these requirements.
- Geographic Limitation: The Services are intended solely for users located within the United States. You represent and warrant that you are accessing the Services from within the United States and agree not to access or use the App or APIs outside of US jurisdiction.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any security breach.
2. Our Role: We Help You Find Independent Food Trucks
- Discovery Service Only: TruckAround is a technology platform that helps diners find food trucks and helps food trucks share their location, schedule, and other information. We do not prepare, cook, handle, store, package, sell, serve, or deliver any food or beverages, and we do not inspect any Vendor, vehicle, kitchen, or food. When you buy from a food truck, you are buying from that Vendor, not from TruckAround, and the transaction is solely between you and the Vendor.
- Vendors Are Independent Businesses: Every food truck and other Vendor listed on the Services is an independent business owned and operated by someone other than TruckAround. Vendors are not our employees, agents, partners, joint venturers, or franchisees. We do not own, operate, manage, supervise, or control any Vendor or its staff, vehicles, equipment, premises, food, prices, hours, or conduct. A Vendor’s appearance on the Services is not an endorsement or recommendation by TruckAround.
- No Guarantees About Vendors: We do not verify, and we make no representation, warranty, or guarantee about, any Vendor’s food safety, sanitation, quality, ingredients, allergens, nutritional content, portion sizes, prices, permits, licenses, insurance, legal compliance, hours, or availability. Information about a Vendor, including its menu, photos, prices, schedule, and location, comes from the Vendor or from the Vendor’s Check-Ins and may be inaccurate, incomplete, or out of date. A truck may not be where, or open when, the Services show.
- Allergies & Dietary Needs: TruckAround cannot tell you what is in any food. If you have a food allergy, intolerance, or dietary restriction, ask the Vendor directly before you order.
- Your Dealings With Vendors: Any question, complaint, or dispute about food, beverages, service, payment, refunds, illness, or injury is between you and the Vendor. To the fullest extent permitted by law, TruckAround is not responsible or liable for any illness, injury, death, loss, or damage arising from any food, beverage, or service a Vendor provides, or from your interactions with any Vendor.
3. Location
- Diners: Sharing your device’s location is optional. If you allow it, the App uses your location to find trucks near you. The rest of the App works without it, and you can turn location access off at any time in your device’s settings.
- Vendors: Checking in requires your device’s precise location. While you are checked in, your location, business name and status are public, as described in our Privacy Policy. If you turn off location access or limit it to approximate location, you will not be able to check in, but you can still use the rest of the Services.
- Your Privacy Rights: How we collect, use, keep and delete location information, and the rights you have over it, are described in our Privacy Policy. We will never treat you differently for exercising those rights.
4. Mobile Application & API License
- App License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices owned or controlled by you in the United States, solely for your personal or internal business purposes.
- API Access: If you are granted access to our backend APIs:
- Access is granted solely via the API keys or authentication credentials issued to you by the Company.
- You may not share, disclose, or distribute your API credentials to third parties.
- You agree to comply with all rate limits, call volume restrictions, and technical documentation provided by us.
- Restrictions: You shall not:
- Reverse engineer, decompile, or disassemble the App, APIs, or underlying source code.
- Attempt to bypass or disable security controls, authentication mechanisms, or rate-limiting safeguards.
- Use automated scrapers, bots, or unauthorized automated tools to interact with the APIs.
- Use the App or APIs to build a competing product or service.
5. User Content & Aggregate Statistics
- User Content Ownership & License: You retain ownership of any original data, text, or materials you upload or submit through the App (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display such content solely to provide, maintain, and improve the Services. This license ends when you delete the User Content or your account, except for copies we keep for the periods stated in our Privacy Policy or as the law requires.
- Aggregate Statistics: We may create statistics from information about how the Services are used, such as the number of trucks in a city. We use and share these statistics only in a form that does not identify any person, device or business, and we will not attempt to re-identify them. We do not sell personal information.
- Dynamic QR Code Redirection Rights: The Company may generate, issue, or provide Quick Response (“QR”) codes or physical/digital assets containing embedded links as part of the Services. You acknowledge and agree that:
- The Company retains sole ownership of and administrative control over the routing, domain infrastructure, and destination URLs associated with any QR code provided by or generated through our Services.
- The Company reserves the absolute right, at its sole discretion and without prior notice or liability to you, to dynamic-reroute, update, modify, or redirect any QR code to any target web URL, mobile application deep-link, or digital destination that the Company deems most appropriate to deliver, maintain, optimize, or safeguard the Services.
- You shall acquire no ownership rights or permanent destination rights in any QR code provided by the Company, and you assume all risk associated with printing or distributing physical materials displaying Company-generated QR codes.
6. Acceptable Use, Safety & Prohibited Conduct
- General Violations: You agree not to use the Services to violate any applicable local, state, national, or federal laws or regulations, transmit malicious code, attempt Denial of Service (DoS) attacks, or scrape data without written authorization.
- Prohibited Hazardous Use & Driving Safety: You explicitly agree that you will not use, view, or interact with the App, APIs, or Services in any manner or setting where doing so creates a safety hazard or risk of physical harm or property damage. Specifically:
- No Distracted Operation: You must NOT access, view, or interact with the App or input data into the App while operating a motor vehicle, heavy machinery, bicycle, or any other motorized or non-motorized transport.
- Safe Environment Required: You agree to use the App only when safely stationary, parked, or in an environment where accessing the App does not endanger yourself or others.
- User Assumption of Risk: You assume total responsibility and liability for strictly adhering to local traffic, safety, and distracted driving laws. The Company shall bear no responsibility or liability for any personal injury, death, or property damage resulting from your failure to comply with this safety restriction.
- Misleading Listing Content: You agree not to post false, misleading, or inaccurate listing content, including menus, descriptions, photos, and business information.
- Complaints & Removal: To report content that you believe is misleading, inaccurate, or violates these Terms, or to request that content be removed, email info@truckaround.app. We may review, edit, or remove content at our discretion.
7. Special Terms for Vendors & Check-In Rules
If you are registered on the App as a merchant, vendor, or commercial account (“Vendor”), you agree to the following terms in addition to the rest of these Terms.
Your Business & Responsibilities
- Independent Business: You operate your business independently of TruckAround, as described in Section 2, and you are solely responsible for every aspect of it, including food preparation, storage, handling, safety, sanitation, and quality; ingredients, allergen information, and labeling; prices and customer service; your staff, vehicles, and equipment; your sales, taxes, and payments; and your compliance with all applicable laws.
- Permits, Licenses & Insurance: You represent and warrant that you hold, and will keep current for as long as you use the Services, every permit, license, health-department approval, registration, and insurance policy required to operate your business wherever you operate it. You agree to provide proof of them if we ask. TruckAround does not verify that you hold them, and our listing you on the Services does not mean that we have.
- Food Safety & Allergens: You are solely responsible for the safety of the food and beverages you provide and for telling customers accurately about their ingredients and allergens. Any menu, ingredient, or allergen information you post on the Services must be accurate and kept up to date, and posting it does not replace your obligation to inform customers at the point of sale.
- Vendor Indemnity: In addition to Section 13, you agree to indemnify, defend, and hold harmless TruckAround and its founders, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising out of your food, beverages, or operations, any illness or injury they cause, or your failure to hold any required permit, license, or insurance.
Photos & Videos
You may upload photos and videos of your business to the Services (“Media”). Media is User Content under Section 5, and the following rules also apply:
- Your Rights to What You Upload: Upload only Media that you own or have every permission needed to use, including permission from any recognizable person in it and the rights to any music, artwork, logos, or trademarks shown or heard in it. You are solely responsible for your Media, and the Vendor Indemnity above also covers any claim that your Media infringes someone else’s rights.
- Accurate Depiction: Media must show your own truck, food, and business and fairly represent what you actually serve. Do not present stock images or another business’s photos or videos as your own.
- Prohibited Media: Do not upload Media that is sexually explicit, violent, hateful, or harassing; that impersonates or disparages another person or business; that shows or promotes illegal activity; or that promotes alcohol, tobacco, or cannabis in violation of the law or in a way that appeals to people under 21.
- Our Rights: We may review, refuse, remove, or limit the display of any Media at our discretion, including after a report under Section 6.
Vendor Subscriptions
- Plans: Some Vendor features are offered through paid subscription plans. Each plan’s features and price are shown in the App or on our website before you subscribe. Any free plan stays free unless we tell you otherwise in advance.
- Monthly Billing: Paid subscriptions are billed monthly, in advance, starting on the day you subscribe.
- Automatic Renewal: Your subscription renews automatically each month at the then-current price until you cancel. By subscribing, you authorize us, or our payment processor, to charge your payment method each month. We will notify you before any price change takes effect.
- Cancel Any Time: You may cancel your subscription at any time in the App or by contacting support@truckaround.app. Cancellation stops future charges and takes effect at the end of your current monthly billing period, and you keep your paid features until then.
- App Store Purchases: If you subscribe through the Apple App Store or Google Play, that store handles your billing and cancellation under its own terms, and you cancel through your store account settings.
Check-In Rules
You agree to adhere strictly to the following check-in requirements:
- Parked and Open for Business Only: Vendors shall only utilize the App’s location check-in feature (“Check-In”) when the Vendor’s truck is parked at a location where the Vendor is actively open and operating for public business, and the Vendor expects to remain there for at least 15 minutes.
- Public Accessibility: Check-Ins are restricted strictly to publicly accessible commercial or event locations where customers are actively permitted to enter or interact. Vendors are strictly prohibited from checking in from private residences, non-public staging areas, or restricted zones unless explicitly permitted for authorized pop-up operations.
- Accuracy of GPS Telemetry: Vendors acknowledge that a Check-In publishes the Vendor’s location to the public, as described in our Privacy Policy. Utilizing GPS spoofing, automated check-in scripts, false location broadcasting, or checking in while closed/inactive constitutes a material breach of these Terms.
- Enforcement & Fraud Penalties: The Company may review Vendor Check-In records, which it keeps as described in its Privacy Policy, to detect fraud and abuse. Any Vendor found violating these rules may face immediate suspension of Vendor privileges, deletion of public listings, or permanent termination of account access without prior notice.
8. API Throttling & Service Availability
- Rate Limits: We reserve the right to monitor API traffic and enforce limits on call volume, payload size, and frequency. Exceeding rate limits may result in temporary or permanent throttling or suspension of API credentials.
- Service Modifications: We reserve the right to modify, update, deprecate, or discontinue features of the App or API endpoints at any time, with or without prior notice.
9. Data Privacy & Security
Your use of the App and APIs is governed by our Privacy Policy, available at https://www.truckaround.app/legal/privacy/, which describes how we collect, use, share, and protect personal information and the privacy rights you have. If these Terms and the Privacy Policy conflict on how we handle personal information, the Privacy Policy controls.
10. Term, Termination, and Suspension
- Termination by You: You may stop using the Services at any time. If you have an account, you can delete it in the App; our Privacy Policy describes what happens to your information when you do.
- Termination by Us: We reserve the right to suspend or terminate your access to the App, APIs, or account immediately, without prior notice, if you breach these Terms, violate rate limits, or engage in fraudulent, harmful, or abusive activity.
11. Disclaimer of Warranties
THE APP, APIS, REAL-TIME LOCATION SERVICES, AND BACKEND INFRASTRUCTURE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR CONTINUITY OF REAL-TIME GPS DATA, AND ACCURACY OF INFORMATION SUCH AS MENUS OR DESCRIPTIONS. VENDORS PROVIDE THEIR OWN LISTING CONTENT, AND WE DO NOT VERIFY IT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCKAROUND AND ITS FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APP OR BACKEND APIS.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS.
13. Indemnification
You agree to indemnify, defend, and hold harmless TruckAround and its founders, officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising out of your misuse of the App or APIs, violation of these Terms, or infringement of third-party rights.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or related to these Terms, the App, the APIs, or the Services shall be resolved by final and legally binding arbitration rather than in court. The arbitration shall be administered by JAMS under its applicable rules and held at the JAMS office in Walnut Creek, Contra Costa County, California, before a single neutral arbitrator. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction. Any claim that is found not to be subject to arbitration shall be brought exclusively in the state or federal courts located in Contra Costa County, California.
You may opt out of arbitration by emailing info@truckaround.app within 30 days after you first accept these Terms. Your email must include your name, the email address of your account (if you have one), and a clear statement that you are opting out of arbitration. If you opt out, disputes between you and the Company shall be brought exclusively in the state or federal courts located in Contra Costa County, California. Opting out of arbitration does not affect any other part of these Terms.
Disputes must be brought individually. You and the Company may each bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate the claims of more than one person or preside over any class, collective, or representative proceeding.
15. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will tell you in the App or by email before it takes effect. Your continued use of the Services after the change takes effect constitutes acceptance of the updated Terms.
16. Electronic Communications
By creating an account or using the Services, you consent to receive legal and transactional electronic communications from us, including account verification messages, administrative notices, security alerts, and updates to these Terms or our Privacy Policy. You acknowledge that these electronic communications satisfy any legal requirement that such communications be in writing. If you have an account, we may also send you occasional news about TruckAround, which you can unsubscribe from at any time.
